Terms and conditions

General terms and conditions of sale established between:

The micro-enterprise Kraft à Nahya, represented by Duvielbourg Agathe, hereinafter referred to as Kraft à Nahya

and

all individuals, hereinafter referred to as "The Client," placing an order with Kraft à Nahya either via the email address kraftanahya@gmail.com or through direct contact.

 

Article 1: Order

Series Items

A series item is an item for which there has been no customization for the Client.

Upon validation and payment of the electronic shopping cart, if all the items in the order are in stock, they will all be shipped to the Client within a maximum period of seven working days.
For items that are not in stock, their production will be initiated within the timeframes indicated on the www.kraftanahya.com website or communicated directly to the Client within seven working days from the validation and payment of the electronic shopping cart.
Once all the items in an order are manufactured and available, the shipment of the order to the Client will take place within a maximum period of seven working days.

Customized Items

A customized item is either an item:

  • derived from a series item and manufactured according to at least one specification, different from that of the equivalent series item, given by the Client.

  • not derived from a series item and manufactured according to a set of specifications given by the Client

 

A free and non-binding quote is provided once the model and specific specifications chosen by the Client are selected, along with an exchange between Kraft à Nahya and the Client regarding the order. Manufacturing and delivery times are indicated to the Client during the exchanges regarding their order and at the time of the quote.

The timeframes are provided for guidance and are subject to change. They depend, among other factors, on the nature of the order, the status of the order book, suppliers, and their carriers.
 

The acceptance of the quote by the Client constitutes the conclusion of the sales contract as well as the acceptance of the description of the items, quantities, and price of the order. Upon acceptance of the quote by the Client, they will be asked to make a non-refundable deposit in case of withdrawal, corresponding to 30% of the total value (excluding any shipping costs) of the order.
 

Costumes are made according to measurements provided by the Client. In the event of an error on the part of the client resulting in one or more modifications to their order, these modifications may be charged.

 

Article 2: Price, Invoicing, and Payment Method

The prices given are in euros and All Taxes Included.

Shipping costs are the responsibility of the Client, and the Client agrees to pay the full price indicated in the quote as well as the shipping costs.

Payment can be made by:

  • bank transfer to the account of Kraft à Nahya, whose bank details will be provided privately to the Client.

  • payment methods available on the website www.kraftanahya.com

 

Article 3: Delivery of the Order and Shipping

Once completed, the order can be delivered to the Client either:

  • in person, subject to agreement between the Client and Kraft à Nahya regarding the location, date, and terms of delivery.

  • by delivery through a third-party carrier. Delivery can be made by Mondial Relay to a relay point or by Lettre Max, Colissimo, or Chronospost through the carrier La Poste. In the case of delivery by Mondial Relay, the choice of the relay point is at the discretion of the Client. In the case of delivery via La Poste, delivery is made to the address indicated during the order.

 

Article 4: Retention of Ownership

In accordance with the law of May 12, 1980, Kraft à Nahya retains full ownership of the goods sold until full payment of the price indicated in the quote.

Kraft à Nahya reserves the right to use photos of the order for promoting the business, whether taken during production, upon completion with or without a model, as well as the drawings made for the execution of the order.

 

Article 5: Complaints and Returns

Any complaints are to be addressed to the email address kraftanahya@gmail.com

The regularity of the sale cannot be disrupted, nor can the responsibility of Kraft à Nahya be engaged for slight variations in the items inherent in the artisanal manufacturing methods used for their production.

For series items, i.e., without customization, the Client has a right of withdrawal of fourteen days from the receipt of their order, in accordance with the provisions of article L221-18 of the Consumer Code of french law.
In the event that the Client exercises their right of withdrawal, they then have a period of fourteen days to return their order. The return is at the expense of the Client and must be sent by the professional carrier of their choice to Kraft à Nahya at 132 avenue Félix Vincent, 44700 Orvault. Kraft à Nahya undertakes to reimburse the Client within fourteen days from the complete receipt of the returned order, in accordance with article L221-24 of the Consumer Code of french law.

For custom or made-to-measure orders, the Client does not have a right of withdrawal in accordance with article L221-28 of the Consumer Code of french law.

 

Article 6: Protection of Personal Data

The information transmitted by the Client to Kraft à Nahya for the processing of an order is confidential, and Kraft à Nahya undertakes to respect its confidentiality.

In accordance with the Data Protection Act of January 6, 1978, the Client has the right to access and rectify data concerning them.

Article 7: Dispute

In the event of a dispute, whatever it may be, their resolution falls under the exclusive jurisdiction of the French courts.
